We offer AI-assisted photo enhancement of existing real estate listing photographs, commissioned by the listing agent or their brokerage (the "Client"). The paid deliverable is a set of full-resolution, watermark-free enhanced photographs ("Enhanced Photos"), produced and delivered only after the Client places an order.
Before any order, we may prepare complimentary, low-resolution, visibly watermarked electronic previews ("Electronic Previews"): on-screen visualizations demonstrating what the proposed enhancement could look like, shown on a private, unindexed preview page addressed solely to the listing's agent. Electronic Previews are proposals, not deliverables: they are not offered for sale or use anywhere, are unsuitable for publication by design (low resolution, watermarked), carry no license of any kind, and exist only so the rights holder can evaluate the proposed work before deciding whether to commission it. No obligation of any kind attaches to viewing them, and the preview page is removed promptly on request (see Section 8) — no purchase necessary.
Placing an order is the Client's instruction and authorization to produce the Enhanced Photos from the listing's source photographs and deliver them. No Enhanced Photos are produced in deliverable form, licensed, or transferred before that authorization. By placing an order you represent and warrant that you (or your brokerage) hold sufficient rights in the source photographs to commission derivative enhancements of them and to use the results as licensed in Section 4.
Upon receipt of full payment, the Client receives a perpetual, non-exclusive license to use the Enhanced Photos for the marketing of the associated property (MLS, print, web, social). No rights transfer before full payment. The Client's ownership of the original source photographs is unaffected. We retain the right to display anonymized before/after samples in our own marketing unless you ask us not to.
The Client is solely responsible for its representation in Section 3. If a third party asserts a claim arising from the Client lacking sufficient rights in the source photographs, the Client agrees to indemnify and hold harmless Real Estate Photographers LLC from the resulting damages and reasonable costs. If we learn that a Client lacked such rights, we may revoke the license and refund the purchase.
Enhanced Photos are produced with AI-assisted editing. Enhancements are intended to improve exposure, lighting, and tidiness — not to misrepresent the property. The Client must review each photo before publishing. MLS, brokerage, and advertising rules on photo editing and disclosure vary and remain solely the Client's responsibility; we make no representation that any particular use complies with them.
Many MLSs treat AI-enhanced photos as "digitally altered" media requiring disclosure. For example, ARMLS (as of May 2026) requires: the original, unaltered photo uploaded directly before or after the altered version; the MLS's own "Digitally Altered" designation applied to each altered photo (in Flexmls, the sunburst icon on the photo); the phrase "Photos are Digitally Altered" in the Public Remarks; and no watermarks other than the MLS-provided mark. Your before/after gallery shows every original next to its enhanced version so the pairs are easy to upload adjacently. This is a courtesy summary, not legal advice — confirm current rules with your own MLS.
Virtually staged photos. Virtual staging is digitally altered media and the disclosure rules above apply to it in full. Delivered staged photos carry no baked-in "virtually staged" logo, watermark, or label: under ARMLS rules (as of May 2026) an on-image staged logo is optional and, where used, must be an MLS-approved mark — while the disclosure that is mandatory (the MLS's "Digitally Altered" designation and the required remarks language) is made by the listing agent in the listing itself, not on the pixels. Making that disclosure — on the MLS, on portals, and anywhere else your rules require it — is solely the Client's responsibility. We recommend disclosing a staged photo wherever it appears.
If you're not satisfied, reply to your receipt email within 7 days for a full refund. On refund, the Section 4 license ends and the Enhanced Photos must not be used thereafter.
The listing agent, brokerage, photographer, or any rights holder in the source photographs may request removal of a preview page at any time, for any reason: reply to any email from us or write info@realestatephotographers.media. We will promptly take the preview page down and delete the associated preview materials. We honor such requests whether or not an order was placed.
We contact each agent at most once, about their own listing. To be added to our do-not-contact list, reply to any email from us or write to info@realestatephotographers.media.
The service is provided "as is," without warranties of any kind, express or implied. To the maximum extent permitted by law, our total liability arising out of or relating to the service is limited to the amount the Client actually paid us for the order giving rise to the claim, and we are not liable for indirect, incidental, or consequential damages.
Real Estate Photographers LLC is an independent service and is not affiliated with, endorsed by, or acting on behalf of any MLS, listing portal, brokerage, or photographer. These terms are governed by the laws of the State of Arizona. If any provision is held unenforceable, the remainder stays in effect. We may update these terms from time to time; the version posted at the time of your order applies to that order.
